Terms of Service

At Aeon Forge, we believe in integrity, transparency, and treating people well. These Terms of Service exist to protect both you and us, ensuring a fair and trustworthy environment for everyone in our community.

We've written these terms to be as clear and straightforward as possible, while including the necessary legal protections for operating in the Web3 space. If anything is unclear, please reach out—we're here to help.

1. Acceptance of Terms

Welcome to Aeon Forge. By accessing or using our website, NFT platform, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

We may update these Terms from time to time. When we make significant changes, we'll do our best to notify you through our website or email. Your continued use of the Services after changes are posted constitutes your acceptance of the modified Terms.

2. Eligibility

Because our Services involve cryptocurrency transactions and NFT ownership with real financial value, you must be at least 18 years old to use our platform. This age requirement helps protect younger users from financial risks and ensures all users can legally enter into binding agreements.

By using our Services, you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • You are not located in a jurisdiction where our Services are prohibited

3. NFTs and Blockchain Technology

3.1 Ownership

When you purchase or mint an NFT through our platform, you own the NFT itself (the blockchain token). Ownership of the NFT is recorded on the blockchain and transferred according to the rules of the underlying smart contract.

3.2 Intellectual Property

Our Approach: We believe in empowering creators and collectors with meaningful ownership. Most of our NFT collections use the CBE-COMMERCIAL-NO-HATE license (provided by a16zcrypto), which grants holders extensive rights including:

  • Full commercial use of the artwork
  • The right to display, distribute, and copy the artwork
  • The right to modify and create derivative works
  • The ability to sub-license rights to others

License Restrictions: In keeping with our values, we reserve the right to terminate the license if the artwork is used in ways that are unlawful, hateful, abusive, harassing, racist, vulgar, cruel, or otherwise harmful. We don't condone hate, abuse, or harassment, and we won't allow our brand or artwork to be used for such purposes.

Default Legal Position: For any collections that don't use this license, or where rights differ, owning an NFT does not automatically grant you:

  • Ownership of intellectual property rights in the underlying artwork or content
  • The right to reproduce, distribute, or create derivative works
  • Commercial rights beyond personal use

Always Check the Details: Specific intellectual property rights for each collection will be clearly stated in that collection's documentation before you mint.

3.3 Risks

You acknowledge and accept the following risks associated with blockchain and NFT transactions:

  • Blockchain transactions are irreversible
  • NFT values can be volatile and may decrease
  • Smart contract vulnerabilities may exist
  • Network congestion may delay transactions or increase fees
  • Regulatory changes may affect NFT ownership or trading

4. Wallet and Security

You are solely responsible for:

  • Maintaining the security of your cryptocurrency wallet
  • Safeguarding your private keys and recovery phrases
  • All transactions initiated from your wallet
  • Losses resulting from compromised wallet security

We do not have access to your private keys and cannot recover lost or stolen assets.

5. Fees and Gas

When using our Services, you may incur:

  • Platform Fees: Fees for minting or trading NFTs (if applicable)
  • Gas Fees: Network transaction fees paid to blockchain validators
  • Third-Party Fees: Fees charged by wallet providers or other services

All fees are non-refundable, even if a transaction fails due to network issues or user error.

6. Prohibited Activities

You agree not to:

  • Use our Services for any illegal purpose
  • Engage in fraudulent activities or market manipulation
  • Violate intellectual property rights
  • Attempt to hack, exploit, or compromise our platform
  • Create fake accounts or impersonate others
  • Interfere with other users' access to the Services
  • Use automated tools or bots without authorization
  • Engage in wash trading or artificial price inflation

7. Disclaimer of Warranties

We strive to provide the best possible experience, but working with blockchain technology means we can't guarantee perfection. We want to be transparent about limitations:

Our Services are provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Services will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of content
  • Warranties about the security of blockchain transactions

8. Limitation of Liability

Blockchain technology operates in a decentralized way, which means there are inherent limitations to what we can control or reverse. To be clear about these boundaries:

To the maximum extent permitted by law, Aeon Forge and its affiliates shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or NFTs
  • Damages resulting from unauthorized access to your wallet
  • Losses due to blockchain network issues or smart contract bugs
  • Actions of third-party wallet providers or marketplaces

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Aeon Forge and its affiliates from any claims, damages, losses, or expenses arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of applicable laws

10. Termination

We're committed to maintaining a safe, fair community for everyone. While we hope it never becomes necessary, we reserve the right to suspend or terminate access to our Services for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Actions that harm our platform or other users
  • Other circumstances that threaten the integrity of our community

In most cases, we'll try to communicate with you first and provide an opportunity to address concerns. However, in situations involving fraud, illegal activity, or immediate harm to others, we may need to act quickly.

Important: Termination of platform access does not affect your NFT ownership, which is controlled by the blockchain and remains in your wallet.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration.

12. Changes to Services

As we grow and improve, our Services will evolve. We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time. When possible, we'll provide advance notice of significant changes that might affect your use of the platform.

We shall not be liable to you or any third party for modifications, suspensions, or discontinuations made in good faith to improve the platform or comply with legal requirements.
